Copyright & Takedown Policy

1. Scope

This policy applies to the Xavana website, Virtual Comic Reader application ("VCR" or the "App"), documentation and other online material controlled by Xavana Consulting ("Xavana", "we", "us" or "our"). It supplements our Terms of Use and does not limit rights or remedies available under applicable law.

We accept copyright reports, including notices modelled on section 512 of the United States Digital Millennium Copyright Act ("DMCA") where relevant. This policy does not expand Xavana's legal obligations.

2. Xavana materials

Unless otherwise stated, the App, website, software, original artwork, designs, text, logos and documentation are owned by Xavana or used under licence and are protected by copyright and other intellectual-property laws. Open-source software, fonts, icons and other third-party materials remain subject to their applicable licences and notices.

No right to reproduce, publish, distribute, modify, sell or commercially exploit Xavana materials is granted except as expressly permitted in writing, by an applicable licence, or by law.

3. Publications used with VCR

VCR is a reader for publications that users supply or lawfully access. Xavana does not provide rights to comics, magazines or other third-party publications. Users are responsible for ensuring that they may lawfully possess, transfer, copy and view their content.

VCR can transfer publications, cover images and posters from a source chosen by the user to the user's headset. Those files and the user's reading activity are not sent to or hosted on Xavana-operated servers. Xavana cannot inspect, remove or disable files stored on a user's device, private network or independent third-party service. Concerns about material hosted elsewhere should normally be sent to the person or service controlling that location.

4. Reporting a copyright concern

If you believe material available through a Xavana-controlled website or service infringes copyright that you own or are authorised to enforce, email vcr@xavana.com. Include:

• your name and contact details;
• identification of the copyrighted work, or a representative list if several works are involved;
• the exact URL or other information needed to locate the material;
• a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law;
• a statement that the notice is accurate and that you are the rights holder or authorised to act for the rights holder (under penalty of perjury where the DMCA applies); and
• your physical or electronic signature.

Please identify specific material rather than an entire website where possible. Do not send complete publication files unless we specifically request a limited item needed to assess the report.

5. How we handle notices

We may request missing information, investigate the identified material and take action required by applicable law or our Terms. This may include correcting attribution, removing or disabling access to material within our control, or declining a request that is incomplete, mistaken or unsupported.

Where appropriate and lawful, we may share the notice with the person who supplied the material so that they can respond.

6. Counter-notices and mistakes

If material you supplied was removed or disabled by mistake, email vcr@xavana.com with your contact details, identification and former location of the material, an explanation, and your signature. A DMCA counter-notice must also include the statements and jurisdictional consent required by 17 U.S.C. § 512(g). We may share it with the original reporter.

7. Misrepresentation

Copyright exceptions and limitations, including quotation, criticism, review, parody and fair use or fair dealing where applicable, can permit use without permission. Do not knowingly make false or materially misleading claims. Misrepresentations may result in liability under applicable law.

8. Personal information and records

We process notices, counter-notices and related correspondence to investigate claims, communicate with the parties, protect legal rights and comply with law. We keep those records only as long as needed for those purposes. See our Privacy Policy.

9. Contact and governing law

This policy is governed by Danish law, without depriving consumers or rights holders of mandatory protections that apply to them. Nothing here determines the jurisdiction or merits of a particular copyright dispute.
