Terms of Use

1. Who we are and acceptance

These Terms of Use ("Terms") are an agreement between you and Xavana Consulting, CVR no. DK34991200, Flaadevej 7, DK-4040 Jyllinge, Denmark ("Xavana", "we", "us" or "our"). They apply to the Xavana website and Virtual Comic Reader application ("VCR" or the "App").

By downloading, installing, accessing or using VCR, you agree to these Terms. If you do not agree, do not use the App. Your acquisition through Meta may also be subject to Meta's store and platform terms. If those terms conflict with these Terms regarding Meta's store or platform, Meta's terms govern that aspect.

2. Eligibility

You must meet the minimum age and account requirements imposed by applicable law and the Meta platform. VCR is not directed to children under 13. If you are under the age of legal majority where you live, a parent or guardian must approve your use and accept these Terms on your behalf.

3. Licence to use VCR

Subject to these Terms and any applicable purchase, Xavana grants you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use VCR on supported devices associated with your authorised platform account for lawful, non-commercial use.

You may not sell, sublicense, rent, distribute or make the App available to others; copy it except as permitted for installation or backup; remove proprietary notices; or reverse engineer, decompile or modify it except to the limited extent that applicable law expressly permits those acts despite this restriction.

4. Your publications and content

VCR is a reader for content that you supply or lawfully access. You retain your rights in your publications, cover images, posters and other content. Xavana does not claim ownership of them. Processing by the App is limited to what is needed to display, organise, cache and manage that content at your direction.

You are solely responsible for confirming that you have all rights and permissions needed to possess, copy, transfer and view content through VCR. You must not use the App to infringe copyright, bypass digital rights management, access another person's files without permission, or handle unlawful or harmful material. VCR does not include or grant rights to third-party publications.

5. Local-network sources and transfers

Optional SMB and local Wi-Fi features are provided for sources and networks you control or are authorised to use. You are responsible for credentials, network security, network or service charges and compliance with the terms that apply to your SMB service and network. Keep pairing codes and passwords private and use these features only on trusted private networks.

Your SMB service and local network are operated independently of Xavana. Their availability, security and changes are outside Xavana's control. Xavana may alter or discontinue a network feature where reasonably necessary for security, compatibility, legal or technical reasons.

6. Purchases, prices and refunds

VCR is distributed through the Meta Horizon Store. Meta handles App purchases and payment processing. Prices, taxes, payment methods and refunds are governed by Meta's store terms and mandatory consumer law. Xavana does not receive complete payment-card details. Unless the law requires Xavana to handle a matter directly, refund requests should be made through Meta.

Features described as optional, premium or "Pro" require the applicable valid entitlement. Attempting to bypass entitlement checks is prohibited.

7. Acceptable use

You must not use the website or App to:

• violate law, intellectual-property rights, privacy rights or another person's rights;
• introduce malware, corrupted files or code intended to damage a device, network or service;
• probe, overload, disrupt or gain unauthorised access to systems, accounts or networks;
• misrepresent your identity, entitlement or relationship with Xavana;
• use automated methods to scrape or extract substantial website content; or
• use VCR in a way that creates a safety risk to you or others.

8. VR safety

Use VCR in a safe environment and follow all headset manufacturer health, safety, boundary and age guidance. Remain aware of your physical surroundings, especially when using passthrough or moving within a virtual environment. Stop using the App if you experience discomfort, dizziness, eyestrain, nausea or disorientation. VCR is not a medical device and is not intended for safety-critical use.

9. Updates and availability

We may provide updates, fixes, compatibility changes and new or altered features. Supported devices, formats, integrations and environments may change. We do not promise that every file will render perfectly or that the App, website or third-party integrations will always be uninterrupted or available. We may suspend a feature where reasonably necessary for security, maintenance, legal compliance or provider compatibility.

You are responsible for maintaining backups of your publications and important information. VCR is not a backup or archival service.

10. Xavana intellectual property

The App, website, software, designs, graphics, logos, documentation and other Xavana materials are owned by Xavana or its licensors and are protected by intellectual-property law. Except for the limited licence in section 3, no rights are transferred to you.

Virtual Comic Reader™, VCR and the Xavana names and logos are marks of Xavana Consulting. Meta Quest is a trademark of Meta Platforms, Inc. Xavana is not affiliated with or endorsed by Meta. Third-party open-source components remain subject to their respective licence notices included with the product or website bundle.

11. Feedback and communications

If you voluntarily send ideas or feedback, Xavana may use them to improve the App and website without an obligation to compensate you. We will not publicly identify you as the source without permission. Personal information in communications is handled under our Privacy Policy.

12. Warranties and consumer rights

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded, including mandatory consumer rights.

Subject to those mandatory rights, the website and App are provided "as is" and "as available". Xavana does not make additional warranties that the App will be error-free, continuously available, compatible with every device or file, or that third-party services will remain available.

13. Liability

Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory product-liability law, or any liability that applicable law does not permit us to limit.

To the fullest extent permitted by law, Xavana is not liable for indirect or consequential loss, lost profit, lost opportunity, loss of content or data, third-party service failure, or damage caused by unauthorised or unsafe use. For consumers, this limitation applies only where it is fair and legally enforceable. You remain responsible for backups and for the safety and legality of content, credentials, devices and networks under your control.

14. Suspension and termination

You may stop using VCR and uninstall it at any time. The licence ends if you materially breach these Terms. Xavana may suspend access to networked or entitlement-dependent features where reasonably necessary to address fraud, abuse, security or legal requirements. Provisions that by their nature should survive termination, including ownership, disclaimers, liability and governing law, will survive.

15. Governing law and disputes

These Terms are governed by Danish law, excluding its conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you normally live. Courts in Denmark have jurisdiction, but consumers may bring proceedings in any court available under mandatory consumer law.

16. Changes, severability and contact

We may update these Terms for legal, security, technical or product reasons. The current version will be posted here with a revised effective date. We will give additional notice of material changes where required by law.

If any provision is unenforceable, it will be limited or removed only to the minimum extent necessary; the remainder continues in effect. A failure to enforce a provision is not a waiver.
